On Friday, March 16, 2012,U.S. District Judge Illston dismissed Michael Boyton’s case contesting the foreclosure on his house. However, the judge is allowing Boyton to refile and in her ruling will lay out the points Mr. Boyton should address when he refiles. In court the judge said “I’m struggling with the consequences if there were irregularities in the (foreclosure) transaction.” California state courts have not been sympathetic to debtors who have fallen behind in their house payments. In California former homeowners must tender the full amount of the loan to assert their claims after nonjudicial forecloses.
